Sheriff's deputies are treating violent assault in Springville as a hate crime

A Holland man is under arrest for assault and deputies in Springville say they're treating this case a hate crime. Erie County Sheriff's deputies say the assault on the 47-year-old male victim was caught on tape by a nearby surveillance camera.

Erie County Sheriff's deputies say this crime was motivated by hatred about sexual orientation. They've charged 26-year-old Joshua Holt with felony assault.

From almost every vantage point on East Main Street in the Springville Business District, there's a surveillance camera mounted. In the early hours of July 25th, one camera recorded a violent assault.

"When I walked down here the next morning, there was quite a bit of blood on the sidewalk, where the assault had taken place," said a Springville man who does not want to disclose his identity. He provided the surveillance footage to the Sheriff's Office and 7 News. It shows three men running across the street towards the pizza shop and then at 1:51am, some kind of altercation breaks out. "There's some pushing and shoving and then you see fists flying and what looks like people kicking and things like that," said the Springville man.

The movement on the tape is hard to see but deputies say the end result was that an out of town man was severely beaten. He was taken to Bertrand Chafee Hospital for treatment and the victim's relatives tell 7 News that he has to undergo surgery for nine broken facial bones. In reviewing the tape, it appears that there were two phases of attack. The first occurred at 1:51am after which some onlookers walked away and then more people joined the scene at 1:56am.

Some Springville residents are horrified that this happened. "The police station is just a block away and you would have just wanted someone to have called, and it could have been stopped or minimized," said Chuck Skillern, a local business owner.

The tape, however, has been of assistance in solving the crime. Last night deputies arrested 26-year-old Joshua Holt outside a bar in Springville.

"They called me later that day after I gave them the videos and they said they were able to identify all but one person on the video that they felt was involved," said the Springville camera owner.

Holt was taken to the Erie County Holding Center. He will be arraigned in Springville Court.
