It was hours after a police standoff began, that James Gilchriese was finally in custody

"He was very unpredictable in a situation like this. You never know what's going to happen," said Sgt. Stephen Mandriak of the New York State Police.

For hours, as daylight turned into dark, Gilchriese had a gun in his hands.

"It was loaded and it was a 9 mm semi automatic handgun," said Mandriak.

One day later, he faces a laundry list of charges, including DWI, Menacing, Unlawful Imprisonment, and criminal possesion of a weapon. The unlawful imprisonment is because his girlfriend was in the car with him for a period of time. It all began after 6 yesterday, with a report that a male was hitting someone in his vehicle. Police responded, getting the woman out of the vehicle. But Gilchriese did not comply with police, beginning the standoff that did not end until after 9. Hostage negotiators stayed on the phone with him, saying he made threats against himself and police officers.

"He was trying to make too many demands. He wanted lots of things that were not going to happen," said Captain Mark Maraschiello of the Buffalo Police Department.

So the SWAT team went in, and were able to get him into custody after using noise and light to distract him.
