Newstead, N.Y. (WKBW) - A tragic accident on the I-90 Thruway westbound in Newstead, killed one person and shut down the New York State Thruway for hours.

It all happened around 10:29p.m. Wednesday night.

Police said a cargo van was stopped on the shoulder of the I-90, then tried to re-enter the roadway. Authorities said the Cargo van did not have any lights on and the truck did not see vehicle.

"The tractor trailer struck the rear of a cargo van, and both vehicles overturned off the north shoulder of the Thruway. The driver of the cargo van was pronounced dead at the scene," New York State Police Sergeant John McGee said.

The driver of the cargo van was partially ejected from the vehicle and died instantly, while the driver of the truck was taken to the hospital with non-life threatening injuries.

The accident caused a section of the New York State Thruway between the Pembroke and Depew exits to shut down in the westbound direction for several hours overnight.

"The two westbound travel lanes of the I-90 were closed from 11 p.m. to 1:37 a.m. Traffic was diverted at the Pembroke exit. At 1:37 a.m. one lane of traffic was open," McGee said.

The freight from the semi truck spilled on the side of the road as the truck rolled over.

"The tractor trailer was carrying 44,000 pounds of aluminum from Oswego, New York to the state of Ohio," McGee said.

The names of the drivers are being withheld at this time until family members are notified.

"It's a tragic accident. Traffic wasn't heavy at the time but it really happens quickly," McGee said.
