Driver arrested after crashing into Batavia Burger King

An Alden man was arrested after crashing into the West Main Street Burger King in Batavia on Thursday night.

Batavia police reported 23-year-old Zachary Dabb crashed into the wall of the Burger King just after 9 p.m. One person inside the building had been sitting near the wall, but got up to get a drink right before the crash. No injuries were reported.

Officers reported finding an open container of alcohol inside Dabb's car. They performed field sobriety tests at the scene. Dabb was later found to have a blood alcohol content higher than .18%.

Officers say Dabb told them he thought he was in another one of his vehicles, and forgot the car he was driving was a standard transmission. He told police he thought the car was in neutral, and was not expecting the car to move forward when he took his foot off the brake.

Dabb was processed by Batavia police and issued appearance tickets for Batavia City Court for DWI, aggravated DWI, and having an open container while operating a motor vehicle. He's due in court on August 31.
