The plan to build a Deep South Taco in North Buffalo has gotten the green light from the Buffalo Planning Board.

The board approved Richard Hamilton's proposal for the new restaurant to be located at the corner of Hertel and Starin.

The proposal, however, comes with some restrictions.

The restaurant can only stay open until 11 p.m. on weekdays and midnight on weekends. Also, a permit for a restaurant patio at the location is only good for one year. After it expires, Hamilton must reapply for another one.

The next step is approval from the Buffalo Common Council.

A public hearing will be held Tuesday at 2 p.m. inside Council chambers.
