Dad pleads guilty to assaulting infant son

Erie County District Attorney John J. Flynn announced that 28-year-old Joseph Jurek, of Alden, plead guilty to two counts of reckless assault of a child.

On Jan. 7, 2018, New York State Police were called to a home on Exchange Street in the Village of Alden for a report of a 4-month-old child that had fallen. The child was taken to Oishei Children's Hospital by his parents.

The child was evaluated at the hospital and it was determined that the child had been shaken to the point of unconsciousness and had suffered other bodily injuries. 

The child continues to recover from his injuries.

Jurek also plead guilty in a separate matter to criminal possession of marijuana in the second degree.

“Not only is Mr. Jurek an irresponsible father, but he is also not the smartest criminal,” DA Flynn said. “He was investigated following a tip from a bank after Mr. Jurek attempted to exchange small bills that smelled of marijuana for larger bills.”

Jurek faces a maximum of seven years in prison, he remains remanded without bail.

He is scheduled to be sentenced on Thursday, July 5 at 2 p.m.
