Pot and Gun Bust in Freedom

Following a three month multi-agency investigation, two (2) people are in custody and a large quantity of marijuana and weapons have been seized by the Southern Tier Regional Drug Task Force.

On Thursday, October 6, 2011 at approximately 5:15 pm a joint investigation by the Wyoming County Drug Task Force, the Buffalo Office of the DEA Task Force and the Southern Tier Regional Drug Task Force culminated in the execution of a search warrant issued by the Honorable MICHAEL NENNO, Cattaraugus County Judge at 10380 Osmun Rd. in the Town of Freedom, Cattaraugus County.

Inside, Task Force Agents discovered the product of a large scale marijuana growing operation with over fifteen (15) pounds of processed marijuana and twenty-two (22) mature marijuana plants seized. Most of the marijuana seized was packaged for sale and has an overall estimated street value of ninety-six thousand dollars ($96,000.00) Additionally four (4) handguns and nine (9) rifles and shotguns were removed from the residence.

JAMES T. NUWER JR. , dob:10/01/69 and MAROLYN S. SMITH, dob:05/29/51 both of 10380 Osmun Rd. Freedom, NY were charged by police with Criminal Possession of Marijuana in the First Degree, a Class C Felony and Criminal Possession of a Weapon in the Third Degree, a Class D Felony. NUWER and SMITH were processed by Cattaraugus County Sheriffs Deputies and arraigned before the Honorable MARY ZINK in Town of Freedom Justice Court where they were both remanded to the Cattaraugus County Jail in Little Valley, NY in lieu of $15,000 cash/$30,000 property bail.

Additional charges are pending in both State and Federal Court pending the final outcome of the investigation.
