The Erie County Sheriff's Office made three DWI arrests overnight. These three arrests are the 236th, 237th and 238th DWI arrests for the Erie County Sheriff's Office in 2013.
In the first incident, Deputy Jonathan Hanna responded to a report of a car that had struck a utility pole on Sharp St. in the Town of Concord. Upon arrival at the scene the driver fled into the woods but was apprehended after a short pursuit. Further investigation revealed the the driver, 34 year old Robert J. Kehr of Gowanda, was intoxicated. He was arrested for DWI and taken to the Erie Co. Sheriff's Substation in Springville for a breath test. The test revealed that Kehr's blood alcohol content was .18% resulting in an additional charge of aggravated DWI. Kehr's charges were upgraded to felonies due to two previous felony DWI convictions in 2012. Kehr was also charged with felony aggravated unlicensed operation as his license was revoked due to the previous DWI convictions. Kehr was held at the Erie Co. Holding Center pending arraignment. Deputy Hanna was assisted by Deputies Jones and Grube.
In the second incident, Deputies Simon Biegasiewicz and Jason Clark stopped a vehicle on Bailey Ave. in the City of Buffalo for failing to keep right. Further investigation showed that the driver, 22 year old Brian E. Bailey Jr., was intoxicated. Bailey was arrested for DWI and taken to the Erie Co. Sheriff's substation on Grand Island for a breath test. The test showed Bailey's blood alcohol content to be .16%. He was released on traffic tickets returnable to Buffalo City Court at a future date.
In the third incident, Deputy George Avery responded to a report of a car in the ditch on Clinton St. in the Town of Elma. Upon arrival, Deputy Avery found that the driver, 67 year old Jack J. Bottoms of Elma, was intoxicated. Bottoms was arrested for DWI and taken to the Erie Co. Sheriff's substation in Elma for a breath test. Test revealed Bottom's blood alcohol content to be .20% resulting in an additional charge of aggravated DWI. He was released on traffic tickets returnable to the Town of Elma Court at a future date.
