JAVA, N.Y. (WKBW) Deputies arrested 44-year-old John Smith of Sardinia on Saturday, charging him with second degree menacing and hunting while intoxicated following an incident on Holland Road in the Town of Java.

Property owners called the Wyoming County Sheriff's Office on Saturday. The owners said they had confronted a man who was hunting on their property without their permission, and that the man had pointed his gun at them.

Deputies located and arrested 44-year-old John Smith and charged him with second degree menacing and hunting while intoxicated. A breathalyzer test performed by officers on the scene found Smith's blood alcohol level was .27%.

Smith was issued appearance tickets and released. He is scheduled to appear in Java Town Court on December 18 to respond to the charges filed against him.
