Erie County Sheriff Patrols make 188th DWI Arrest

Erie County Sheriff Timothy B. Howard reports the arrest of eight people on Friday night by Sheriff’s Road Patrols for alcohol related arrests.

While on patrol in Newstead at approximately 7:27PM, Deputies Simon Biegasiewicz and Lee Richard arrested Mark T. Jones (29) of Buffalo and charged him with Felony DWI - Drugs, Heroin Possession, Marihuana Possession and multiple traffic infractions after investigating a citizen complaint of reckless operation on Main Road. The felony charge was filed due to a prior conviction for DWI within ten years. Jones refused to submit to a blood test to determine his level of intoxication. A passenger in his vehicle: Nicholas J. Church (27) of Rocky Point was also charged with Heroin and Marihuana possession. Both offenders were processed and released on appearance tickets for Newstead Court.

While on patrol in Alden at approximately 10:55PM, Deputy Biegasiewicz arrested Christopher P. Jones (46) of Tonawanda and charged him with DWI and traffic infractions after stopping his vehicle for erratic operation on Crittenden Road. A breath test revealed his blood alcohol content to be .15%. He was released on appearance tickets for Alden Court.

While on patrol in Springville at approximately 12:54AM, Deputies Ken Achtyl and Ben Pisa arrested Carla A. Infantino (30) of Niagara Falls and charged her with DWI and Failure to Yield at a Stop Sign after the Deputies investigated a two car personal injury motor vehicle crash at Rt. 219 and Rt. 39. An occupant of the other vehicle involved was transported by ambulance to Bertrand Chaffee Hospital with apparently non – life threatening injuries. A breath test revealed her blood alcohol content to be .12%. She was processed and released on appearance tickets for Concord Court.

While on patrol in Alden at approximately 12:58AM, Deputy Lee Richard arrested Philip D. Burke (26) of Buffalo and charged him with D Felony DWI, Felony Aggravated Unlicensed Operation (Revoked license), and traffic infractions after he stopped his vehicle for driving through a red light on Broadway Ave. The “D” Felony charge was filed due to Burke having two prior convictions for DWI within the last ten years. Burke refused to submit to a breath test to determine his blood alcohol content. He was processed and transported to the Holding Center to await arraignment on his charges in Alden Court.

While on patrol in Clarence at approximately 1:25AM, Deputy Simon Biegasiewciz arrested an eighteen year old offender from Clarence and charged him with DWI after investigating a citizen complaint about an intoxicated driver in the drive thru at Tim Horton’s on Main Street. The offender refused to submit to a breath test to determine his blood alcohol content. He was processed and released on appearance tickets for Clarence Court. The name of the offender is not released due to his age.

While on patrol in Tonawanda at approximately 2:31AM, Deputy Jason Clark arrested Kirk J. Zinermon (44) of Tonawanda and charged him with DWI, Trespassing, Unlicensed Operation, Failure to Yield to an Emergency Vehicle, and Failure to take a Breath Screening Device after Deputy Clark stopped his vehicle in Ellicott Creek Park after hours. Zinermon refused to submit to a breath test to determine his blood alcohol content. He was processed and released on appearance tickets for Tonawanda Court.

While on patrol in Clarence at approximately 3:29AM, Deputies Simon Biegasiewicz and Lee Richard arrested Cody T. Rogers (19) of North Tonawanda and charged him with DWI and traffic infractions after stopping his vehicle for erratic operation on Main Street. A breath test revealed his blood alcohol content to be .13%. He was processed and released on appearance tickets for Clarence Court.

While on patrol in Marilla at approximately 4:49AM, Deputies John Szczepanski and Mike Sluberski arrested Anthony T. Wojcik (29) of Alden and charged him with DWI, Failure to Maintain the Roadway, and Failure to Keep Right after investigating the complaint of a property owner who stated his lawn was damaged when Wojcik drove his vehicle off the road on Clinton Street. A breath test revealed his blood alcohol content to be .12%. He was processed and released on appearance tickets for Marilla Court.

These arrests were the 181st – 188th for DWI by Sheriff’s Road Patrols in 2013.
