Erie County Considers Hiring More CPS Workers

BUFFALO, NY (WKBW) - Erie County Child Protective Services says it is cooperating with an external investigation into the death of Eain Brooks, 5, of Buffalo.

Brooks was beaten to death, police said, more than a week ago.

His mother's boyfriend, Matthew Kuzdzal is charged with second-degree murder.

"Erie County DSS will take responsibility for any concerns regarding the performance of our staff. If appropriate, staff will be held accountable," Social Services Commissioner Carol Dankert-Maurer told the Health and Human Services Committee of the Erie County Legislature on Tuesday.

"And we commit to taking any and all steps necessary to address performance and improve functionality of this critical service," she said.

Eain's family has accused county CPS workers of failing to protect Eain, despite several attempts to warn county officials the he was in danger.

Also on Tuesday, Kuzdzal appeared in city court. His attorney, Robert Cutting, waived a felony hearing sending the case to a grand jury.

"I think it could best be described as a tragic accident... not an intentional killing. I think my client is heartbroken over the loss of a child that he regarded as his own son," Cutting said.

On Thursday, county lawmakers are expected to vote on a proposal submitted by the county executive to hire additional child abuse investigators. Seven for a new child protective service team and three managers.
