Drunk Driver Heads to Prison Following Fatal Crash

AMHERST, NY (WKBW) - 53-year-old David Smith, the man responsible for striking and killing two pedestrians with his motorcycle last November, is heading to prison for his crime.

Smith was sentenced to four to 12 years behind bars after pleading guilty to 1st degree vehicular manslaughter, 2nd Degree Vehicular Assault and Driving While Intoxicated.

Last November Smith drove his motorcycle drunk, careened onto the Amherst Bike Path and struck and killed 25-year-old Jocelyn Elberson and 81-year-old Sheila Pelton. The incident also seriously injured Pelton's 79-year-old husband.

During sentencing, Jocelyn's Father Charles Elberson said he can not forgive Smith for taking away his precious daughter. Elberson says he will now make it his mission to reform current state laws so the punishment for repeat D.W.I. offenders are stricter. Prosecutors say this was Smith's 5th or 6th D.W.I., including one in North Tonawanda in 2000.
