( release) On March 22, 2011 the State Police on the Thruway arrested the following subject for Criminal Possession of Marihuana 2nd, a class D Felony, 2 counts of Criminal Possession of a Weapon 4th, Class A Misdemeanors, Unlawfully Growing Cannabis, a Class A Misdemeanor, Possession of a Controlled Substance Outside the Original Container, a Violation, and Unlawful Possession of Marihuana, a Violation.
State Police patrolled to 2 Winkler Road in the Town of Cheektowaga to serve an arrest warrant out of the Town of West Seneca Court for the defendant, who was located sleeping inside the residence. Next to the defendant, in plain view, was a marihuana smoking device and an overwhelming odor of marihuana coming from the area of a walk in closet next to the bed. Consent to search the home was obtained from the owner of the property and the defendant himself, which revealed a closet that was set up as a marihuana growing operation that included potted plants, fertilizer, potting soil, fluorescent lights, marihuana growing literature, and walls that were lined with foil. Several plastic bags of marihuana vegetation were discovered that contained a total weight of 867.27 grams (30.59 ounces). Also located in the bedroom were a metal collapsible baton, a dagger knife, a digital scale and packaging materials, and a half tablet of Soma (muscle relaxer).
