Cattaraugus County District Attorney Lori Pettit Rieman on Wednesday announced court activity for Sept. 1, Sept. 6 and Sept. 7.

SEPTEMBER 1

SCOTT A. HARRIS, d/o/b 10/30/1956, of Olean, New York, entered a plea of guilty to Attempted Rape in the First Degree, a class C violent felony, to satisfy a pending indictment. The incident occurred between June 13, 2010 and June 15, 2010, when the defendant engaged in sexual intercourse with another person who was less than eleven years old. Sentencing is scheduled for November 14, 2011.

SEPTEMBER 6

JONATHAN M. NEISS, d/o/b 2/28/1983, of Olean, New York, but presently incarcerated in the Cattaraugus County Jail, entered a plea of guilty to Attempted Criminal Sale of a Controlled Substance in the Fourth Degree, a class E felony. The incident occurred on or about December 15, 2010, in the City of Olean, when the defendant knowingly and unlawfully attempted to sell Hydrocodone pills. Sentencing is scheduled for November 21, 2011.

ANTHONY LICHT, d/o/b 11/21/1986, of Olean, New York, but presently incarcerated in the Cattaraugus County Jail, entered a plea of guilty to Criminal Sale of a Controlled Substance in the Fourth Degree, a class C felony. The incident occurred on or about January 7, 2011, in the City of Olean, when the defendant knowingly and unlawfully sold Hydrocodone pills. The defendant was also on probation at the time he committed the present crime. Sentencing for both matters is scheduled for November 21, 2011.

JOSHUA B. FULLER, d/o/b 5/18/1994, of Hinsdale, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Attempted Burglary in the Third Degree, a class E felony. The incident occurred on or about May 1, 2011, in the Town of Hinsdale, when the defendant knowingly attempted to enter or remain unlawfully in a building with intent to commit a crime therein. Sentencing is scheduled for November 21, 2011.

RONAL J. HAYNOSKI, d/o/b 3/6/1981, of Portville, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Driving While Intoxicated, a class E felony. The incident occurred on or about May 23, 2011, in the Town of Allegany, when the defendant operated a motor vehicle in an intoxicated condition, having a .14% BAC. Sentencing is scheduled for November 21, 2011.

JEREMIAH L. CALKINS, d/o/b 2/14/1987, of Jamestown, New York, but presently incarcerated in the Cattaraugus County Jail, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Rape in the Third Degree, a class E felony. The incident occurred on or about July 17, 2011, in the Town of Yorkshire, when the defendant being 21 years old or more, engaged in sexual intercourse with another person who was less than 17 years old. Sentencing is scheduled for November 21, 2011.

RICHARD E. CHILDS, II, d/o/b 11/8/1985, of Olean, New York, but presently incarcerated in the Cattaraugus County Jail, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Burglary in the Third Degree, a class D felony and Criminal Possession of a Weapon in the Fourth Degree, a class A misdemeanor. The first incident occurred on or about July 20, 2011, in the Town of Hinsdale, when the defendant knowingly entered or remained unlawfully in a building with intent to commit a crime therein. The second incident occurred on or about July 24, 2011, in the Town of Hinsdale when the defendant possessed three (3) Black Daggers. Sentencing is scheduled for November 21, 2011.

PAUL R. NEWELL, d/o/b 10/24/1975, of Steamburg, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Aggravated Driving While Intoxicated, a class E felony and Aggravated Unlicensed Operation of a Motor Vehicle in the Second Degree, a misdemeanor. The incident occurred on or about May 20, 2011, in the Town of Randolph, when the defendant operated a motor vehicle while he was intoxicated, having a .23% BAC and at a time his license was suspended or revoked as a result of a prior alcohol conviction. Sentencing is scheduled for November 21, 2011.

DALE A. REDEYE, d/o/b 08/29/1979, presently incarcerated in the SCI Smithfield Correction Facility, Huntingdon, Pennsylvania, entered a plea of guilty to Attempted Criminal Sale of a Controlled Substance in the Third Degree, a class C felony. The incident occurred on or about September 2, 2009, in the City of Salamanca, when he knowingly and unlawfully and sold crack cocaine. Sentencing is scheduled for October 3, 2011.

ROBERT W. EVANS, d/o/b 12/05/1955, of Salamanca, New York, entered a plea of guilty to Driving While Intoxicated, a class E felony, to satisfy a pending indictment. The incident occurred on or about February 23, 2011, in the City of Salamanca, when he operated a motor vehicle in an intoxicated condition, having a .16% BAC. He also entered a guilty plea to Forcible Touching, to satisfy another pending indictment. That incident occurred on or about September 26, 2010, in the City of Salamanca, when the defendant intentionally, and for no legitimate purpose, forcibly touched the sexual or other intimate parts of another person for the purpose of degrading or abusing such person or for the purpose of gratifying his own sexual desire. Sentencing on both matters is scheduled for November 21, 2011

TIFFANY L. CHIARILLI, d/o/b 3/22/1978, of Cuba, New York, was sentenced to five years probation, 100 hours of community service, $1,000 fine and her license was revoked for her conviction of Aggravated Driving While Intoxicated, a class E felony. The incident occurred on or about July 31, 2010, in the Town of Farmersville, when the defendant operated a motor vehicle in an intoxicated condition, having a .10% BAC and at a time when she had three children under the age of 15 in the vehicle.

SEPTEMBER 7

JAMES GOULD, d/o/b 11/06/1975, of Great Valley, New York, but presently incarcerated in the Cattaraugus County Jail, entered a plea of guilty to Criminal Sale of a Controlled Substance in the Fifth Degree, a class D felony. The incident occurred on or about January 14, 2011, in the City of Olean, when he sold Hydrocodone pills. Sentencing is scheduled for November 21, 2011.
