RICHARD D. FARNHAM, JR., d/o/b 10/21/1978, of Salamanca, New York, but presently incarcerated in the Cattaraugus County Jail, entered a plea of guilty to Attempted Criminal Sale of a Controlled Substance in the Fifth Degree, a class E felony, to satisfy a pending indictment. The incident occurred on or about September 20, 2010, in the City of Salamanca, when the defendant attempted to sell Xanax pills. He also waived prosecution by indictment and entered a guilty plea by Superior Court Information to Attempted Burglary in the Third Degree, a class E felony. The incident occurred on or about April 28, 2011, in the Town of Great Valley, when Farnham, along with others, knowing attempted to enter or remain unlawfully in a building with intent to commit a crime therein. Both of these crimes were committed while the defendant was on probation for a previous burglary that he committed in 2008 and by virtue of the guilty pleas, he admitted violating his probation. Sentencing for all three chases has been scheduled for November 7, 2011.

HAROLD J. GRAVES, d/o/b 5/31/1980, of Port Allegany, Pennsylvania, was arraigned and entered a plea of not guilty to an indictment that charges him with Course of Sexual Conduct Against a Child in the Second Degree, a class D felony; and Endangering the Welfare of a Child, a class A misdemeanor. The indictment charges that between June 2007 and April 2009, in the Town of Hinsdale, the defendant engaged in two or more acts of sexual conduct with a child less than eleven years old. The matter has been adjourned for motions.

MICHAEL J. WARD, d/o/b 3/24/1988, of Olean, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with Assault in the Second Degree, a class D felony and Unlawful Possession of Marijuana, a violation. The assault occurred on or about June 15, 2011, in the City of Olean, when the defendant with intent to cause physical injury to another person, caused such injury to such person. Further, on or about August 5, 2011, the defendant unlawfully possessed marijuana. The matter has been adjourned for motions.

DAVID J. VATTES, d/o/b 8/4/1976, of Olean, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with Criminal Sale of a Controlled Substance in the Fourth Degree, a class C felony; and Criminal Possession of a Controlled Substance in the Fifth Degree, a class D felony. The incident occurred on or about March 17, 2011, in the City of Olean, when the defendant possessed and sold Suboxin. The matter has been adjourned for motions.

MATT W. SHIELDS, d/o/b 6/7/1982, of Randolph, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with two counts of Driving While Intoxicated, class E felonies. The incident occurred on or about February 24, 2011, in the Town of Randolph, when the defendant operated a motor vehicle in an intoxicated condition, having a .17% BAC. The matter has been adjourned for motions.

JULIE BARNES, d/o/b 9/3/1971, of Olean, New York, entered a plea of guilty to Attempted Criminal Sale of a Controlled Substance in the Fifth Degree, a class E felony, to satisfy a pending indictment. The incident occurred on or about November 11, 2010, in the City of Olean, when the defendant attempted to sell Xanax pills. Sentencing is scheduled for November 7, 2011.

RAYMOND A. TURNER, d/o/b 10/21/1979, of Salamanca, New York, entered a plea of guilty to Attempted Criminal Sale of a Controlled Substance in the Third Degree, a class C felony, to satisfy a pending indictment. The incident occurred on or about September 25, 2009, in the City of Salamanca, when the defendant attempted to sell cocaine. Sentencing is scheduled for November 7, 2011.

THOMAS GILRAY, d/o/b 12/17/1961, of Allegany, New York, waived prosecution by Indictment and entered a plea of guilty by Superior Court Information to Attempted Reckless Endangerment in the First Degree, a class E felony. The incident occurred on or about February 22, 2011, in the Town of Allegany, when the defendant, under circumstances evincing a depraved indifference to human life, attempted to recklessly engage in conduct which created a grave risk of death to another person. Sentencing is scheduled for November 14, 2011.

FRANKLIN K. NEPHEW, d/o/b 4/7/1933, of Versailles, New York, waived prosecution by Indictment and entered a plea of guilty by Superior court Information to Driving While Intoxicated, a class E felony. The incident occurred on or about April 29, 2011, in the Town of Perrysburg, when the defendant operated a motor vehicle in an intoxicated condition, having a .14% BAC. Sentencing is scheduled for November 7, 2011.

SHANE A. RICE, d/o/b 12/12/1989, of Olean, New York entered a plea of guilty to Burglary in the Third Degree, a class D felony, to satisfy a pending indictment. The incident occurred on or about October 31, 2010, in the City of Olean, when the defendant, along with a co-defendant, knowingly entered or remained unlawfully in a building with intent to commit a crime therein. Sentencing is scheduled for October 17, 2011.

NEIL A. MCCARVILLE, d/o/b 5/12/1983, of Buffalo, New York, waived prosecution by Indictment and entered a plea of guilty by Superior Court Information to Aggravated Driving While Intoxicated, a class E felony. The incident occurred on or about February 12, 2011, in the Town of Machias, when the defendant operated a motor vehicle in an intoxicated condition while a child less than 15 years old was a passenger in the motor vehicle. Sentencing is scheduled for November 14, 2011.

TERRY G, BROWN,JR., d/o/b 07/26/1989, of Warsaw, New York, but presently incarcerated in the Wyoming County Jail, was sentenced as a predicate felon to a determinate term of two years in the New York State Department of Corrections, to be followed by a two year term of post-release supervision for his conviction of Criminal Sale of a Controlled Substance in the Fifth Degree, a class D felony. The incident occurred on or about July 19, 2011, in the City of Olean, when he knowingly and unlawfully sold Xanax pills.

JOSHUA J. ELLIS, d/o/b 4/7/1981, of Freedom, New York, was sentenced to five years probation, 240 hours of community service, $2,000 fine and his driver’s license was revoked for his conviction of Driving While Intoxicated, a class E felony. The incident occurred on or about September 16, 2010, in the Town of Freedom, when he operated a motor vehicle in an intoxicated condition, having a .19% BAC.

PAMELA J. DAVIS, d/o/b 03/27/1960, of Jamestown, New York, was sentenced to five years probation, 100 hours of community service, $1,000 fine and her driver’s license was revoked for her conviction of Driving While Intoxicated, a class E felony. The incident occurred on or about May 12, 2010, in the Town of Dayton, when the defendant operated a motor vehicle in an intoxicated condition, having a .14% BAC.

ROBERT J. MCCLAIN, d/o/b 12/1/1972, of Olean, New York, but presently incarcerated in the Cattaraugus County Jail, was sentenced to a one year term in the Cattaraugus County Jail for his conviction of Criminal Trespass in the Second Degree. The incident occurred on or about December 13, 2010, in the City of Olean, when the defendant knowingly entered or remained unlawfully in a dwelling.
