LOCKPORT, N.Y. (WKBW) - The building of a multi-million dollar facility in Niagara County is causing controversy.

The facility for Yahoo! is causing controversy because of a mandate attached to the deal which requires Yahoo! to contribute millions of dollars to a Buffalo non-profit...not a Niagara County one.

Under the incentive package given to Yahoo! to expand it's Lockport operation, it must give the Community Foundation for Great Buffalo $3.5 Million.

That foundation does a lot of good for the city of Buffalo. One of the biggest programs is the "Say Yes to Education" Program which gives college scholarships to city teens.

Niagara County Legislator Rick Updergrove wonders why a Niagara County non-profit wasn't chosen.

"These monies could further enhance the quality of life for the residents of Niagara County, and make us more attractive for businesses looking to locate or expand here," said Updergrove.

Updergrove says his intention is not to take funds away from the Buffalo agency, but he is calling for a review to make sure the process benefits Niagara County as well.
