Batavia Police discover 1-year-old child left alone in apartment

A Batavia man, wanted by police on a petit larceny charge, has also admitted to leaving his one-year-old child alone in a hot apartment.

Police say they responded to the apartment on North Spruce Street around 9:30 p.m. Monday, looking for 40-year-old Charles Rodriguez Sr. in connection to an ongoing investigation.

Officers say they were unable to locate Rodriguez at his apartment.

According to investigators, a television could be heard and a light was on. A concerned neighbor told officers that the one-year-old was in the apartment alone and unsupervised.

Authorities say the fire department was called to assist in the rescue of the child. An officer then scaled the ladder and entered the apartment through a window.

The child was found awake in a crib in the room, according to police. The temperature in the apartment was recorded at 85 degrees.

During the investigation, it was found that the child's mother was staying in Buffalo overnight and had allegedly left Rodriguez in charge of taking care of the child.

Rodriguez was later located at the apartment on Tuesday morning and was arrested and taken to Batavia City Court to be arraigned on the charge of endangering the welfare of a child. He pled guilty and was taken to the Genesee County Jail for a six month sentence.

Rodriguez also pled guilty to the petit larceny charge from an incident at Dollar General earlier in the week.

Police say it was later discovered that Rodriguez was also wanted by Cheektowaga Police on warrants for failure to comply with drug court.
