Town of Hamburg, NY (WKBW) - The man accused of murdering an assistant manager at the Toys 'R Us store in Hamburg appeared before a judge.

The hearing for Bernard Grucza was short. However, we learned that the case is going before a grand jury. The Erie County District Attorney has six days from the time of Grucza's arrest to get a grand jury indictment.

The deadline to get an indictment is Tuesday. That is the date of Grucza's preliminary hearing.

On Wednesday, Grucza was arrested for the stabbing death of Larry Wells. He has pleaded not guilty to second degree murder.

Grucza's attorney released a statement telling ABC News, "Bernard Grucza did not murder Larry Wells, and we are confident that he will be vindicated at trial."

Wells' family told ABC News that, "he was an amazing person, a wonderful husband and the best father. We miss him everyday."
