EDEN, NY (WKBW)-Eden police are investigating a Tuesday shooting on Jennings Road in Eden. Police say the incident happened at 3:30 p.m. outside a home on Jennings road when a 21-year-old brother was removing his 40 caliber pistol from his pocket, when it somehow fired. The bullet struck his 18-year-old brother in the abdomen. The Eden Emergency Squad responded to the call and the teen was taken to ECMC by Mercy Flight. He is listed in critical but stable condition at the hospital. Police say the 21-year-old has a permit for the pistol and bought it to get rid of woodchucks. Detectives say there was no fight or quarrel between the brothers before the shooting happened. The name of the victim and his brother were not released. The case has been sent to the district attorney's office, but no charges have been filed. Police are waiting for the teen's condition to improve before getting his account of the events.
