TOWN OF BRANT, NY (WKBW) -A young Brant woman, accused of driving drunk and killing a 7-month-old baby appeared in Brant Town Court for a felony hearing. The case against 24-year-old Danielle Kellogg will now move to a state supreme court after she waived her right to the felony hearing Friday afternoon. Kellogg is accused of driving drunk Tuesday morning along Route 20 in Brant and crashing her S.U.V. into an oncoming car. The collision seriously injured the other driver, 31-year-old Denise Hine and killed her 7-month-old infant, Baylee Dion.

Baylee's Family say attending today's court proceeding was important to make sure justice is served in this case, not vengeance.

"With the holiday season upon us, we had a lot to look forward to, but now its filled with uncertainty," said Baylee's Uncle Jared Wilson. "We just have to keep looking to God for the strength to keep moving forward."

Kellogg's Attorney Thomas Casey declined comment following Friday's proceeding. Nearly 3 years ago, Kellogg was charged in Cattaraugus County with D.W.I. after crossing the center line in her vehicle in the Town of Pomfret. Erie County Sheriff's Deputies say the charge was later reduced. Kellogg remains free on $20,000 cash bail.
