OP Attempted Home Invasion, Victims Speak

Anthony Guarino, 22 appeared in Orchard Park Town Court Thursday
for a felony hearing.

He pleaded not guilty to attempted burglary, criminal mischief, and possession of marijuana.

Guarino was arrested on September 1, 2014 along with his alleged accomplice Jacob Rappleye, 18.

Police say the two men went to a Transit Road home and tried to break in by climbing up the side of the home with a ladder.

The father and son who were inside the home, Paul and Russell Smith heard the noises and ran outside with their shotguns holding the suspects until police arrived.

Guarino's felony hearing was adjourned until September 16, 2014 at 2pm in Orchard Park Town

Rappleye's next court appearance is also September 16th at 2pm.
