AMHERST, NY (WKBW) The driver who crashed her vehicle into the Cheeburger Cheeburger restaurant in Amherst, killing two people, will not face criminal charges.
Amherst Police issued a summons to Beverly Kasmore-Torbet for excessive speed, which is a traffic violation.
Police say "driver inattention" was also a contributing factor in the crash and that mechanical failure did not play a role.
That crash killed Joseph and Kathryn Bennet and injured several others back on September 17.
Amherst law makers passed a resolution that would look to require barriers for all new business construction to protect patrons inside on Monday night.
