New York Court Rules Spanking 'Reasonable Force'

Central Islip, NY (WKBW) A Long Island father is now off the hook for a spanking incident that dates back to October of 2012.

Court documents say the father spanked his 8-year-old son for cursing at an adult during a party at a friend's house, spanking him both at the party and at home.

The Associated Press reports that Suffolk County social services officials launched an investigation. They alleged that the father used an open hand and a belt on the boy when they returned home. Following the investigation, a family court judge found him guilty of child neglect.

The father pursued an appeal, and an Appellate Division judge dismissed the child neglect ruling last week. The judge ruled that in the case of spanking his child with his hand, the father used "reasonable force." The judge also ruled that there was insufficient evidence that the father ever used a belt to strike his son.
