Buffalo, N.Y. (WKBW) - Erie County Judge Penny Wolfgang sentenced Mark Urban to five years probation for embezzling more than $60,000 from his family business, The Urban Brothers Funeral Home.

"I just commented on the unfortunate situation of this because it involved family members and how sad it is for everyone involved," Defense Attorney Herb Greenman said.

Urban wrote bad personal checks. His attorney Herb Greenman said he used the money to live when the economy went bad. Urban also failed to report this money on his state income taxes, therefore scamming thousands of dollars from the government. He pled guilty to Grand Larceny in the 2nd and 3rd degree. Urban offered no apologies in court.

"He's accepted responsibility and everyone needs to move on at this time," Greenman said.

That is easier said than done. This has been such a public case that Urban has had a hard time finding a job in Western New York so the attorney asked the judge if he could move to Florida.

"She gave him permission to relocate out of the area which is necessary for him to live and repay the restitution," Greenman said.

Urban has paid back about less than half of the money. His attorney said now he will find a job and work to pay back more than $30,000 to the family business and about $3,000 to the state.
