BUFFALO, N.Y. (WKBW) - A man indicted on rape and incest charges had his bail revoked Tuesday morning after the Erie County Assistant District Attorney says he tried to intimidate her Monday night.

William Payne, who is currently on trial after being accused of rape and incest, had his $25,000 bail revoked due to the allegation of intimidating the Assistant DA while she was leaving the office around 7 p.m.

A motion was made to revoke Payne's bail and declare his trial a mistrial.

A criminal investigation will now take place to determine if Payne will face charges for the alleged incident Monday night.

Erie County District Attorney Frank Sedita says surveillance video helped make the determination.

Payne's rape trial has been rescheduled for August.
