A local man accused of raping and trying to kill a 10-year old girl faced a judge, Friday.
Kim Tipton, 32, was in Niagara City Court for what was scheduled to be a preliminary hearing on charges of Attempted Second Degree Murder, Criminal Sex Act, Sexual Abuse and Assault.
That hearing did not take place because Tipton faces Felony charges and was indicted by a Grand Jury, Thursday. The case will now be handed over to County Court.
Tipton was arrested last weekend for allegedly raping a child then cutting her throat with a steak knife. The girl was rushed to the hospital, treated and released. She is expected to be fine.
Tipton is being held at the Niagara County Jail with no bail. He will be in Niagara County Court in the next few weeks.
