Local Babysitter Arrested for D.U.I. - Kids in Car

Hamburg, N.Y. (WKBW-TV) - Julie and David Wagonblott are now counting their blessings.
"Thank god they weren't hurt or anything like that," says David.
Their two kids, Kaileen and David, were recently taken on a wild ride. The person behind the wheel was 27 year old Rachel Martinez-- the very woman-- who was suppose to keep them safe.
"She seemed like the perfect babysitter-- until July 14th," Julie Says.
July 14th-- when Martinez-- had picked up the kids to take them to the zoo.
"That was at 11 o'clock, two hours later, the police are calling me letting us know the kids are in custody and the babysitter got into a car accident," says Julie.
The kids were not hurt but Martinez was arrested by police.
"They were under the impression that she was under the influence of something," says Julie.
That "something", according to police, was a drug called cyboxin-- a powerful substance-- used to treat heroin addiction!
Police say Martinez-- the woman these parents trusted--- is a recovering addict.
"You have to watch who you hire," says David.

The Wagonblotts thought they did.

They found Martinez on craigslist. They performed a three hour in home interview--- even a background check!
"We did a check on her and she was totally clean," David Says.
Martinez had no criminal record-- no trail left behind indicating any problems.
On paper and in person she truly was??
"The perfect babysitter-- the perfect babysitter- yeah," the Wagonblotts both said.
Martinez did not return our phone calls.
She could be charged under the new Leandra's law-- which makes it a felony to drive under the influence with children in the car.
It carries a maximum penalty of 4 years in jail.
