Buffalo, NY (WKBW) -The Lawyers representing Dr. James Corasanti are seeking a dismissal of charges.

Dr. James Corasanti was charged with manslaughter, vehicular manslaughter, leaving the scene of an accident and evidence tampering, after police say he struck and killed 18-year-old Alexandria Rice last July on Heim Road in Amherst.

Prosecutors say the doctor was drunk, texting, and speeding when he struck Rice, who was riding her longboard alongside the road. They also claim Corasanti tried to covered up what happened following the crash.

Wednesday, Daniels requested mental health records for the the 18-year-old and claim Rice had marijuana in her system before the crash and wrote on social media sites about depression and suicide.

Prosecutors said in Court the request is a blatant attempt to try and blame the victim in this case. Erie County Court Judge Sheila DiTullio reserved her decision on the request for a dismissal of the charges. All parties concerned are expected back in court early next month.
