Kenmore Man Plans to File Lawsuit Over Police Brutality in Buffalo

BUFFALO, N.Y. (WKBW) An attorney representing Christopher Kozak of Kenmore says he has filed a 'notice of claim' with the City of Buffalo and plans to file a lawsuit.

The action comes after the 43-year old Kozak says he was beat up by Buffalo Police officers outside a Chippewa Street bar on March 17th.

The incident was recorded on video.

Kozak also claims that one of the officers that hurt him was Buffalo Police Officer Robert Eloff.

Eloff is currently on an unpaid suspension following an incident at Molly's Pub on Main Street in Buffalo during May.

Air National Guardsman William Sager, Jr was severely injured and left in a coma after prosecutors says Sager was pushed down a flight of stairs by the bar's manager.

A surveillance system at Molly's was disconnected shortly after Sager was injured, and prosecutors say images recovered from the video system show Eloff and Basil walking towards the camera before it went black.
