Judge Allows Cockpit Recordings in 3407 Trial

BUFFALO, NY (WKBW) - U.S. District Judge William Skretny granted a motion Wednesday that will allow for the use of the cockpit voice recorder audio from Continental Connection Flight 3407 to be used in the future trial.

Attorney's for the victim's families have argued that without access to the recording, they would be denied a fair trial. They claimed that the written transcript of the recording is incomplete, and the recording contains evidence relevant to pre-impact terror, conscious pain and suffering, the pilots' attentiveness and other circumstances that cannot be judge through the written transcript.

After reviewing the cockpit recorder audio, Judge Skretny ruled that allowing the recording is necessary to allow for a fair trial. The wrongful death trial is scheduled to being in March of 2012.
