Hamburg Man Charged With DWI Following Crash Injuring Two People

HAMBURG, N.Y. (WKBW) - A local man is behind bars following a two-car accident on Lake Shore Road in Hamburg late Monday night, which left two people in critical condition.

Town of Hamburg Police is investigating the accident that occurred around 11 p.m. on Lake Shore Road at the Route 179 overpass.

Police say 28-year-old Thomas Gilray of Hamburg was driving his 2012 Dodge pickup westbound when he struck a 2004 Chevrolet suburban which was disabled in the left lane from a previous accident caused by weather conditions.

Gilray disregarded a police officer outside his vehicle attempting to secure the accident scene, almost hitting the officer.

Gilray continued onto the overpass, striking the victim's vehicle, which lurched forward and struck two passengers standing in the front of their disabled vehicle.

The two people struck, a 61-year-old from Hamburg and a 32-year-old from Hopewell Junction, were transported to ECMC and are currently in critical condition. Their names are not being released.

Gilray and his two passengers were not seriously injured. He displayed signs of intoxication, but refused to submit a chemical test. Police obtained a court order to have his blood drawn.

He was charged with DWI, Reckless Endangerment, Vehicular Assault, and Failure to Yield to an Emergency.

Gilray was arraigned Tuesday in Town of Hamburg Court. He was remanded on $5,000 bail.
