Hackemer Family Files Suit Against Darien Lake

BUFFALO, NY (WKBW-TV) - The Buffalo News is reporting the family of Sgt. James T. Hackemer has filed a wrongful death lawsuit.

Hackemer was killed after he fell out of the Ride of Steel roller coaster at Darien Lake Theme Park Resort on July 8. Hackemer was allowed to board the roller coaster despite having no legs.

According to the published report, the Hackemer family is now filing a law suit against the owners of Darien Lake, and the management company of the theme park.

Eyewitness News reached out to the law firm of Cellino and Barnes, reported to be representing the family, and are awaiting a response.

Darien Lake officials responded to Eyewitness News on Saturday, simply stating that they can not comment on pending litigation.

The 29-year-old Iraq veteran lost both of his legs and a hip during a roadside bomb back in 2008 when he was serving as a sergeant in the army.
