Buffalo N.Y. (WKBW) A local activist group is not giving it up when it comes to their intent to have a local casino shut down.

Earlier this year, a judge ruled that the Seneca Buffalo Creek Casino was not an illegal operation after Citizens Against Casino Gambling in Erie Count filed a lawsuit.

The activist group has now filed an appeal for the second time against that judge's decision, citing many reasons they want the casino shut down.

A co-chairperson for the organization says they believe the land on which its built is not sovereign land as required under federal law before a tribe can legally gamble.

They also dispute the Judge's decision that federal law prohibiting gambling on any land acquired after 1988 did not apply to the Senecas.
