Buffalo, N.Y. (WKBW) - Danielle Kellogg faces DWI and vehicular Manslaughter charges in the November crash that killed seven-month-old Baylee Dion. Authorities said Kellogg was drunk behind the wheel at 9 a.m.
The attorney for Baylee's family said Kellogg would plead guilty to Vehicular Manslaughter in the First Degree in Erie County Court, Wednesday. She faces a maximum sentence in New York of up to 15 years behind bars.
Kellogg's SUV crossed the center line on Route 20 in Bryant and crashed into an oncoming car driven by Baylee's mom Denise Hine. She was seriously injured and Baylee was killed. The baby's family is still emotionally scarred.
"It's like it's not real and I'm going to wake-up and hold my daughter," victim's dad Scott Dion said.
This isn't Kellogg's first time in trouble with the law. In November of 2009, she pled guilty to Driving while Ability Impaired in Chautauqua County. Her blood alcohol level then was 0.12.
