The Erie County Sheriff's Department report the Felony DWI arrest and subsequent narcotics charges of a Delevan man following a traffic stop on Savage Rd. in the Town of Sardinia.
Erie County Sheriff's Deputies Theresa Nietzel and Jason Bouton responded to a customer trouble call at an establishment on Olean Rd. in the Town of Sardinia. The troubled customer, 28 y/o Codey A. Tingue of Pleasant Valley Rd. in Delevan, drove away from the scene prior to patrol's arrival.
Tingue was located by Deputy Nietzel a short time later on Savage Rd. in Sardinia. Upon further investigation and field sobriety tests, Tingue was found to be intoxicated, prompting a DWI charge. It was further discovered that Tingue had a previous DWI and his driver's license was revoked for prior DWI offenses, raising his DWI to a felony along with a felony aggravated unlicensed operation of a motor vehicle charge. Tingue refused any further procedures and BAC testing.
Upon the search of Tingue incidental to his arrest, Tingue was found to be in possession of 11 grams of cocaine and 2.7 grams of marijuana causing Tingue to be additionally charged with criminal possession of a controlled substance 4th(C felony) and unlawful possession of marijuana(violation).
Tingue was taken to the Erie County Holding Center and held pending his arraignment in the Town of Sardinia Court.
The vehicle was towed with a 12 hour DWI hold.
This was the 220th DWI arrest by the Sheriff's Office this year.
