Patrol initiated a traffic stop and spoke with the driver/registered owner, PAMELA ORMSBY, (age 45 from Lewiston) who stated that the front plate did come off back in February of this year.
Patrol could detect the odor of an alcoholic beverage coming from the breath of ORMSBY as she spoke. ORMSBY also had slurred speech, glassy, bloodshot eyes and impaired motor coordination. ORMSBY stated that she was coming from her parent’s house where they were just celebrating a birthday. Patrol stated that she and her fourteen your old son (who was in the front passenger seat) were driving home from the party.
Patrol had ORMSBY exit the vehicle in order to perform field sobriety testing. ORMSBY was immediately unsteady on her feet when exiting the vehicle. Patrol administered four field sobriety tests of which she failed three. ORMSBY also provided a positive reading for the presence of alcohol on a roadside alcohol detection device. ORMSBY was arrested for driving while intoxicated, read her DWI/Miranda warnings and she refused to take a chemical breath test for her blood alcohol content.
ORMSBY was brought back to the Niagara County Sheriff’s Office where she was also charged with endangering the
welfare of a child, felony DWI under Leandra's Law, and she was issued addition tickets for no front plate and driver’s view obstructed. Patrol notified Child Protective Services of the arrest. ORMSBY was remanded to the Niagara County Jail in lieu of $750 and given a court date in the Town of Niagara on 08/22/11 at 1800hrs.
