Class Action Lawsuit Filed Against Tonawanda Coke

Tonawanda, N.Y. (WKBW-TV) - There is more legal trouble for a Town of Tonawanda company found to be polluting the air.
Tonawanda coke is now facing a class action lawsuit from residents who live near the plant.
The lawsuit was filed Monday by attorney Charles Cobb on behalf of nearly 30,000 residents who live in the areas near the plant.
They are suing the River Road company for causing property damage and loss of quality of life.
The lawsuit also calls for medical monitoring in those areas.
Over the past year, Tonawanda Coke has faced federal and state fines after investigators found it was releasing high amounts of benzene into the air.
The company is also accused of other environmental crimes.
The class action lawsuit names the plant, its owner, J.D. Crane, and Environmental Controls Manager Mark Kamholz as defendants.
The lawsuit does not deal with the many health concerns in the areas surrounding Tonawanda Coke.
Separate, individual lawsuits are expected to be filed on behalf of those who claim the pollution is making them ill.
A Community Meeting will be held to discuss the lawsuit on Tuesday, September 28th.
