David Smith Pleads Guilty to Bike Path Crash Charges

(WKBW) - The man accused of driving drunk and plowing over three people on a bike path in mid-November pleads guilty.

David Smith plead guilty to vehicular manslaughter in the first degree, vehicular assault in the second degree and Driving While Intoxicated.

On November 11th, Smith drove his red motorcycle onto a bike path in Amherst, killing 25-year-old Jocelyn Elberson and 81-year-old Sheila Pelton.

79-year-old Foster Pelton was critically injured.

The Erie County District Attorney's office says the charges that Smith plead guilty to, are higher than those initially filed against him.

The charges are the highest for which Smith could have been convicted if he had gone to trial.

Smith faces a maximum prison sentence of 15 years.

He will be sentenced on March 14th.
