BUFFALO, N.Y. (WKBW) - A Buffalo man accused of shooting a bystander outside an Allentown restaurant will be arraigned next week on assault and weapons charges.
20-year-old Deverick Petty was indicted Monday on two counts of first degree assault and one count of criminal possession of a weapon after police say he shot 30-year-old Edwin Andino outside the Allen Street Bar and Grill back in June.
Police say Petty was fighting with his girlfriend and another man when he opened fire. A stray bullet missed his alleged target and hit Andino, who was across the street.
If convicted, Petty faces a maximum 25 years in prison.
He will be arraigned on Monday.
