Alden, N.Y. (WKBW-TV) Alden Highway Superintendent, Gary Wagner was arraigned on a criminal trespassing charge Tuesday.

The charge stems from an incident last month, when Wagner allegedly entered property owned by Mark Moore on Broadway Street in the town.

Moore says this is not the first time town officials have entered onto his property without permission. He thinks Wagner was "snooping" and trying to dig up dirt on his construction company. Moore believes it's some sort of retaliation for backing the man who ran against and lost to Wagner in the last election.

Wagner pleaded not guilty in town court and is due back before a judge next month.
