BUFFALO, NY (WKBW) -- BUFFALO, NY (WKBW) -- A former Western New York teacher was re-sentenced Wednesday after already serving two-years of a previous sentence.
James Van Valkinburgh pleaded guilty in 2008 for having a sexual relationship with a 16-year-old student while working as a social studies teacher at Sacred Heart Academy.
Van Valkinburgh admitted to raping the 16-year-old repeatedly over a course of several months in 2007 and was sent to prison in 2008. But due to a court error back in 2008, he was granted the right to waive his original guilty plea, since it was discovered the judge in the original case had a conflict of interest. In court Wednesday, Van Valkinburgh waived that right, and the former teacher was sentenced for the second time in this case.
Van Valkinburgh will now serve 7 -years behind bars for raping the student. He has already spent two years in prison and will receive credit for time served towards his new sentence.
