BUFFALO, NY (WKBW) -- Sources close to the investigation tell Eyewitness News that the intruder shot to death after entering the wrong home in Amherst on March 28 had a blood-alcohol level more than two times the legal limit for driving.
31-year-old David Park was a teacher in Albany, NY who was shot after entering the wrong home on Millbrook Court in Amherst in late March.
The source tells us that toxicology tests show Park's blood-alcohol level was 0.18, which is double the 0.08 legal limit for driving while intoxicated.
A grand jury is expected to hear evidence on the shooting death later this month. They will decide whether the home-owner's actions were justified.
